Cancellations

Guests may cancel the booking at any time provided that the cancellation is communicated to Discover Hidden Panama in writing, by email: info@discoverhiddenpanama.com. Cancellation charges will be applied as shown below calculated from the day written notice is received.
 
Period prior to arrival date cancellation:
60 days and more…………………………………..100% deposit refunded at guests’ own expense, minus administration fee of $50.
 
8 to 59 days………………………………………….reimbursement of deposit and/or change of the total price of the reservation is not guaranteed and depends exclusively on the possibility of re-booking the reserved cabin. Check sub-paragraphs (i) (ii) of this clause.
 
0 to 7 days…………………………………………..Non-refundable. Check sub-paragraphs (iii) (iv) of this clause.
 
(i) If the cabin is re-booked, the guests can either request a reimbursement of 50% of the deposit received, at guests’ own expenses, or a credit of 100% of the deposit received to be used within the following two years, minus an administrative fee of $50.00. The reimbursement or the credit will be done on a prorate basis if the cabin can only be re-rented for a portion of the original stay.
 
(ii) If the cabin could not be re-booked, when the reservation is cancelled for reasons or circumstances above guests’ control, the guests can request a credit of 50% of the received deposit to be used within the following two years. When a reimbursement or a 100% credit is requested in relation to a reservation, no other credit is available.
 
(iii) The entire cost of the reservation is always due if changes to the reservation are made less than a week, on or after arrival. In case of no-show, the deposit is kept in all instances.
 
(iv) If the guests have paid in full the reservation prior to their arrival and that they had to partially or completely cancel their reservation at least one week prior to arrival date, for any reason, the money received above the required 50% deposit is always returned, at guest own expenses. The required 50% deposit will be treated as set above.
 
(v) For all reservations made for two or more cabins, and for any reservation made for the Christmas/New Year period, and other festive seasons, any changes or cancellations must be received at least three months prior to arrival date in order to guarantee the reimbursement of the entire deposit, as described above.
 
(vi) The above mentioned credits of deposit paid can only be used for payment of deposit, not toward the entire cost of the reservation and cannot be used between Christmas and New Year, and other festive seasons, except if the cancelled nights were between Christmas and New Year, and other festive seasons.
 
2. Alterations and Cancellation by the Organizer
(a) Without prejudice to the Consumer’s statutory rights, the Organizer reserves the right to alter, change, curtail or cancel any Program.
 
(b) If as consequence of “force majeure” (as defined in sub-paragraph (e) of this clause), the Organizer is obliged to curtail, alter, extend or cancel a holiday, the Consumer shall not be at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of the said curtailment, alteration, extension or cancellation of the scuba diving package.
 
(c) If prior to the arrival date there is a cancellation of a program, the Consumer shall be entitled to withdraw from the contract without penalty
 
(d) No compensation shall be payable where the alteration is for the reasons referred to in sub-paragraph (b) of this clause
 
(e) “force majeure” means unusual or unforeseeable circumstances beyond the control of the Organizer, other suppliers of services, the consequences of which could not have been avoided even if all due care had been exercised or an event which the Organizer, the supplier of services even with all due care could not foresee or forestall, including Acts of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with the package, riots, acts or war, civil commotion, exercise of legislative, municipal, military or other authority, strikes, industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any carrier or service supplier connected with the scuba diving package, fraud perpetrated against the Organizer or any other reason beyond the control of the Organizer.
 
3. Substitution
If any member of the party is prevented from travelling due to death, injury or serious illness of the client, close friend or relative, redundancy or jury service, it may be possible to transfer the booking to another suitable person (accepted by Organiser) provided a written notice must be given at least 7 days prior to arrival.
 
4. Age, Fitness and Participation
All clients participating in any activity are expected to satisfy themselves prior to arrival that they are fit and able to participate in any activity and small boat travel. The Operator has the right to conduct a check up at extra expenses of the client.
 
The following documents should be available prior to any scuba diving activity.
(a) Proof of the clients scuba diving certification level by an internationally recognised certifying agency is mandatory.
 
(b) A “Divers Medical Statement” and “Liabilty release and assumption of risk agreement “ should be signed before any scuba diving activity.
 
The Operator reserves the right to refuse or cancel any scuba diving activity without compensation if the client does not comply with this clause.
 
5. Insurance
(i) Travel insurance is recommended for any person whilst on an organised tour with the Organiser. Clients are wholly responsible for arranging their on travel insurance.
 
(ii) Clients participating in any activity.
Proof of a suitable travel insurance that should provide adequate coverage. For scuba diving activities, a specific scuba diving insurance coverage (eg DAN) is always recommended.
 
(iii) The Operator and Organiser reserve the right to refuse or cancel any activity without compensation if the client does not comply with sub-paragragh (ii) of this clause
 
6. Responsibilities
The operator and Organiser are not responsible for any loss or damage to personal equipment during our programs.
